A Mensa Et Thoro A mensa Et Thoro is Latin for "from bed and board." The term refers to a type of divorce where the marriage remains valid, although the couple is deemed separated. Such type of divorce is generally granted for causes of extreme cruelty or desertion of the wife by the husband. This divorce does not, however, affect the legitimacy of the children. Also, it does not authorize the separated couple to remarry. A mensa et thoro divorce is very uncommon as couples usually get a complete divorce which is referred to as vinculo matrimonii. However, there are several reasons why a couple may want a mensa et thoro divorce. For instance, in certain jurisdictions, getting a full divorce is very difficult. A couple may start with a mensa et thoro divorce to show to the court that they are serious about separating and then seek full divorce. A couple having temporary problems may also seek such divorce to see whether they can work out thier differences while legally separated.
