Arrearages Arrearages refers alimony or child support payments that are overdue. Most states have adopted laws that make it extremely difficult or impossible to get rid of arrearages. For instance, arrearages cannot be discharged through bankruptcy, and courts generally will not retroactively cancel overdue alimony or child support payments. A spouse or parent who is facing financial difficulties and is unable to make payments should immediately request a temporary modification of the payments before the arrearages build up and get out of control. REMEMBER, arrearages cannot be discharged through bankruptcy.
